CONSTITUTION OF THE LIBERTARIAN PARTY OF KANSAS
As tentatively approved as a Proposed Constitution by the LPKS Executive Committee on 1.9.2016
Article I. NAME
The name of this organization shall be the Libertarian Party of Kansas. Alternate names and the nature of the organization shall be set forth in the By-Laws.
ARTICLE II PURPOSE
Section A. The purpose of this organization is to be a political party committed to the principles embodied in the LPKS Statement of Principles.
Section B. The purpose shall be accomplished by publishing political and educational information to the voting public; by nominating candidates for political office in accordance with state law and the By-Laws of the party; and by performing other activities consistent with operating and maintaining a political party.
ARTICLE III MEMBERSHIP
The membership of this party will be those persons registering as Libertarians in the State of Kansas. Membership may be further defined in the By-Laws.
ARTICLE IV. OFFICERS
The appointed and elected officers and the method of their election shall be set forth in the By-Laws.
ARTICLE V. THE STATE CONVENTION
All power and authority to govern this party is given to the State Convention, which shall meet yearly at a place and time set by the State Executive Committee.
ARTICLE VI. THE STATE EXECUTIVE COMMITTEE
The State Executive Committee shall consist of members as defined in the By-Laws. The State Executive Committee is charged with the day-to-day operation of the party.
ARTICLE VII. MEETINGS AND QUORUM
The meetings and quora of the various committees, the State Executive Committee and the State Convention shall be set forth in the By-Laws. The State Convention shall meet each year.
During each annual meeting the State Convention shall, among other things, nominate and elect members of the State Executive Committee whose terms are expiring; when necessary, nominate candidates; and consider proposed amendments to the Party Constitution, By-Laws, Statement of Principles, or Platform.
ARTICLE VIII. STATEMENT OF PRINCIPLES
The Statement of Principles affirms the philosophy of the Libertarian Party and the principles upon which it is founded. It is made by a reference herein a founding document along with this Constitution and the By-Laws of the Party. All amendments to the Statement of Principles requires a vote of 7/8 of the members registered at the State Convention.
ARTICLE IX. DISCIPLINE
As this is a Party of Principle and as we wish those principles to be the governing ideals of the Party, the Party holds unto itself the right to discipline those who act in violation of those principles. Causes and methods for discipline may be set forth in the By-Laws.
ARTICLE X. PARLIAMENTARY AUTHORITY
This body adopts the edition of Robert’s Rules of Order as specified in the By-Laws as its parliamentary authority.
ARTICLE XI. AMENDMENTS TO THE CONSTITUTION
This Constitution may be amended by a two-thirds vote of members present and voting at any Annual Meeting except as set forth in Article VIII.
ARTICLE XII. ORGANIZATIONAL CONFORMANCE WITH THE KANSAS ELECTION CODE
The requirements of the Kansas Election Code and any other pertinent statute shall constitute a part of this Constitution and shall supersede any conflicting provisions hereof.
ARTICLE XIII. AFFILIATE ORGANIZATIONS
The By-Laws may set forth provisions for chartering affiliate organizations.
Change Amendment to: AMENDING PARTY DOCUMENTS Changes to party documents may be proposed by a 2/3 vote of the Executive Committee, or proposed by any member in writing with 5 member signatures. Posting and comments are per the By-Laws. By-Law changes are in effect when passed by the Committee, but expire at the time the next State Convention is convened. They become permanent when ratified by a majority at the Convention. Convention votes required to ratify changes to other party documents are : Constitution 2/3 majority; Statement of Principals 7/8 majority; Platform 2/3 majority.
Change Article VIII as follows: ARTICLE VIII PARTY DOCUMENTS Party documents shall consist of this Constitution, By-Laws, Statement of Principals and Platform.
Change Article VI to: The Executive Committee shall consist of the officers listed in Article IV. It is charged with the day-to-day operation of the party.
Change Article IV to: Officers shall be: Chair, Vice Chair, Secretary, Treasurer, and one representative from each Federal Congressional District. They shall be elected at the State Convention as specified in the By-Laws.
In Article I. NAME add "(LPKS)" after the Libertarian Party of Kansas since the term LPKS is used throughout the rest of the document.
